Your purchases are subject to return or exchange solely in accordance with our Refund Policy.

本規約は、お客様に対し、本サービスを個人的かつ非商業的な目的で利用することのみを許可するものです。お客様は、当社の事前の書面による同意なく、本サービス上の資料を複製、配布、変更、二次的著作物の作成、公衆への表示、実演、再掲載、ダウンロード、保存、または送信してはなりません。

本規約で明示的に定められている場合を除き、本規約は、Japan TCG Direct、Shopifyまたは第三者の特許、商標、著作権その他の知的財産権について、お客様にライセンスまたはその他の権利を付与するものではありません。本サービスの無断使用は、連邦および州の知的財産法に違反する可能性があります。本規約で明示的に付与されていないすべての権利は、Japan TCG Directに留保されます。

Japan TCG Directの名称、ロゴ、商品名、サービス名、デザインおよびスローガンは、Japan TCG Directまたはその関連会社もしくはライセンサーの商標です。お客様は、Japan TCG Directの事前の書面による許可なく、これらの商標を使用することはできません。Shopifyの名称、ロゴ、商品名、サービス名、デザインおよびスローガンは、Shopifyの商標です。本サービス上に表示されるその他の名称、ロゴ、商品名、サービス名、デザインおよびスローガンは、それぞれの所有者の商標です。

第7条 任意ツール

本サービスの一部として、第三者が提供する顧客向けツールへのアクセスが提供される場合があります。当社は、これらのツールを監視せず、管理も関与もしません。

お客様は、当社がこれらのツールを「現状有姿」および「提供可能な範囲」で提供しており、いかなる保証、表明、条件または承認も行わないことを承認および同意します。当社は、任意の第三者ツールの利用に起因または関連するいかなる責任も負いません。

サイトを通じて提供される任意ツールの利用は、すべてお客様自身の責任および判断で行うものとします。お客様は、関連する第三者提供者が定める利用条件を十分に理解し、承認したうえで利用する必要があります。

当社は将来、本サービスを通じて新機能を提供する場合があります。これには新しいツールやリソースの公開を含みます。これらの新機能も本サービスの一部とみなされ、本利用規約の対象となります。

第8条 第三者リンク

本サービスには、第三者が提供または運営するウェブサイトへの資料およびハイパーリンクが含まれる場合があります。埋め込まれた第三者機能を含みます。当社は、お客様がアクセスする第三者資料またはウェブサイトの内容や正確性を確認または評価する責任を負いません。お客様が本サービスを離れてこれらの資料または第三者サイトにアクセスする場合、お客様自身の責任で行うものとします。

当社は、第三者ウェブサイトへのアクセス、または第三者ウェブサイト上の商品、サービス、リソース、コンテンツの購入または利用に関連する損害について責任を負いません。取引を行う前に、第三者のポリシーおよび慣行をよく確認し、理解してください。第三者の商品およびサービスに関する苦情、請求、懸念または質問は、当該第三者に直接お問い合わせください。

第9条 Shopifyとの関係

Japan TCG DirectはShopifyを利用しており、これにより当社は本サービスをお客様に提供しています。ただし、当店で行われるすべての販売および購入は、Japan TCG Directとの間で直接行われます。

本サービスを利用することにより、お客様は、ShopifyがJapan TCG Directとの販売に関するいかなる側面についても責任を負わないことを承認および同意します。これには、購入商品またはサービスに起因する負傷、損害または損失を含みます。お客様は、Japan TCG Directとの購入および取引に起因または関連するすべての請求、損害および責任について、Shopifyおよびその関連会社を明示的に免責するものとします。

第10条 プライバシーポリシー

当社が本サービスを通じて収集するすべての個人情報は、当社のプライバシーポリシーの対象となります。また、一部の個人情報はShopifyのプライバシーポリシーの対象となる場合があります。本サービスを利用することにより、お客様はこれらのプライバシーポリシーを読んだことを承認します。

本サービスはShopifyによってホストされているため、Shopifyは本サービスの提供および改善のため、お客様による本サービスへのアクセスおよび利用に関する個人情報を収集および処理します。お客様が本サービスに送信した情報は、お客様にサービスを提供するため、Shopifyおよびお客様の居住国とは異なる国に所在する場合がある第三者に送信・共有される場合があります。当社、Shopifyおよび当社のパートナーによる個人情報の利用方法の詳細については、当社のプライバシーポリシーをご確認ください。

第11条 フィードバック

お客様がアイデア、提案、フィードバック、レビュー、企画、計画、その他のコンテンツ（以下総称して「フィードバック」といいます）を提出、アップロード、投稿、メール送信、またはその他の方法で送信した場合、お客様は当社に対し、当該フィードバックをあらゆる媒体で、あらゆる目的のために使用、複製、変更、公開、配布および表示する、永続的、全世界的、サブライセンス可能、ロイヤリティフリーのライセンスを付与するものとします。これには商業利用を含みます。

当社は、このライセンスに基づく権利を、本サービスの運営、提供、評価、強化、改善、宣伝、および本利用規約に基づく義務の履行や権利行使のために利用する場合があります。

お客様は、以下を表明および保証します。

（1）すべてのフィードバックについて所有権または必要なすべての権利を有していること
（2）フィードバックの提出に関連して受け取った報酬またはインセンティブを開示していること
（3）フィードバックが本規約に準拠していること

当社は、フィードバックについて、機密保持、報酬の支払い、または回答を行う義務を負いません。

当社は、義務ではありませんが、当社の単独の裁量により、違法、不快、脅迫的、名誉毀損的、中傷的、ポルノ的、わいせつ、またはその他不適切であると判断したフィードバック、または第三者の知的財産権もしくは本利用規約に違反するフィードバックを監視、編集または削除する場合があります。

お客様は、フィードバックが第三者の権利、著作権、商標、プライバシー、人格権その他の個人的または財産的権利を侵害しないことに同意します。また、フィードバックに名誉毀損的、違法、虐待的、わいせつな内容、または本サービスや関連ウェブサイトの運営に影響を与える可能性のあるコンピューターウイルスその他のマルウェアを含めてはなりません。

お客様は、虚偽のメールアドレスを使用したり、他人になりすましたり、フィードバックの出所について当社または第三者を誤認させたりしてはなりません。お客様は、自身が行うフィードバックおよびその正確性について単独で責任を負います。当社は、お客様または第三者が投稿したフィードバックについて、いかなる責任も負いません。

第12条 誤記、不正確な情報および記載漏れ

本サービス上または本サービス内には、商品説明、価格、プロモーション、オファー、送料、配送期間、在庫状況などに関連して、誤字、不正確な情報または記載漏れが含まれる場合があります。当社は、誤記、不正確な情報または記載漏れを訂正し、情報を変更または更新し、また情報が不正確である場合には、予告なく注文をキャンセルする権利を有します。これは注文送信後であっても適用されます。

第13条 禁止事項

お客様は、合法的な目的でのみ本サービスにアクセスおよび利用することができます。お客様は、直接または間接を問わず、以下の目的で本サービスにアクセスまたは利用してはなりません。

（a）違法または悪意のある目的
（b）国際、連邦、州、地域の規則、法律、条例に違反する目的
（c）当社または第三者の知的財産権を侵害する目的
（d）当社従業員またはその他の人物に対して、嫌がらせ、虐待、侮辱、加害、名誉毀損、中傷、軽蔑、威迫または損害を与える目的
（e）虚偽または誤解を招く情報を送信する目的
（f）本規約に準拠しない資料を送受信、アップロード、ダウンロード、使用または再使用する目的
（g）広告または販促物、ジャンクメール、チェーンメール、スパムその他類似の勧誘を送信する目的
（h）他人または法人になりすます、またはなりすまそうとする目的
（i）その他、当社が判断するところにより、他者による本サービスの利用または享受を制限または妨げる行為、Japan TCG Direct、Shopifyまたは本サービスの利用者に損害を与える可能性のある行為、または責任を生じさせる可能性のある行為

さらに、お客様は以下を行わないことに同意します。

（a）本サービスの機能または運営に影響を与える可能性のあるウイルスその他の悪意あるコードをアップロードまたは送信すること
（b）本サービスの一部を複製、複写、コピー、抽出、販売、再販売または利用すること
（c）他者の個人情報を収集または追跡すること
（d）スパム、フィッシング、ファーミング、または口実を用いた情報取得を行うこと
（e）ロボット、スパイダー、スクレイピング、データ収集・抽出ツール、自動装置またはプロセス、AIツール（自律型AIを含む）、その他自動または手動の手段を用いて本サービスにアクセスすること
（f）当社が本サービスへのアクセスを制限するために採用するセキュリティ機能、認証機能、robots exclusion headers、その他の措置を妨害、回避または迂回すること

当社は、お客様が本規約の一部に違反したと判断した場合、予告なくいつでもお客様のアカウントを停止、無効化、または終了する権利を有します。

第14条 エージェント

14.1 本条（以下「エージェント条項」といいます）は、お客様が本サービスへのアクセス、利用または操作のためにエージェントを使用、許可、有効化、または導入した場合に適用されます。「エージェント」とは、個人または法人を代理して、またはその指示に基づき、自律的または半自律的に行動し、直接の監督なしにデバイス上で実行され得るソフトウェアまたはサービスを意味します。

14.2 エージェントは、常に自らを識別し、以下14.4条の要件に厳格に従って運用されない限り、本サービスにアクセス、利用、または操作することはできません。また、当社が特定のサービスへのアクセス、利用または操作を控えるよう要求した場合、エージェントは当該サービスにアクセス、利用または操作することはできません。

14.3 当社は、技術的措置を含む手段により、エージェントが本サービスにアクセス、利用、または操作できるかどうか、またその方法を制限する場合があります。

14.4 エージェントは、以下を遵守しなければなりません。

（i）すべてのHTTP/HTTPSリクエストにおいて、ユーザーエージェント文字列に「Agent/[agent name]」を含め、リクエストがエージェントによるものであること、およびエージェント名を開示すること
（ii）人間の行動や操作パターンを模倣すること、またはCAPTCHAその他人間とコンピューター利用を区別するための措置を完了または回避することなどにより、エージェントによるアクセス、利用または操作であることを隠蔽または不明瞭にしないこと
（iii）操作が人間によるものかコンピューターによるものかを判断するための質問またはプロンプトに対して、真実を回答すること
（iv）エージェントによる本サービスへのアクセス、利用または操作をブロック、制限、変更または管理するための措置を迂回、回避または無効化しないこと

第15条 終了

当社は、当社の単独の裁量により、いつでも予告なく本契約またはお客様による本サービスへのアクセスの全部または一部を終了することができます。お客様は、終了日までに発生したすべての金額について引き続き責任を負います。

本契約終了後も、知的財産、フィードバック、終了、保証の免責、責任の制限、補償、分離可能性、権利放棄、完全合意、譲渡、準拠法、プライバシーポリシー、および性質上存続すべきその他の条項は引き続き適用されます。

第16条 保証の免責

本サービス上または本サービスを通じて提供される情報は、一般的な情報提供のみを目的として提供されます。当社は、当該情報の正確性、完全性または有用性を保証しません。お客様が当該情報に依拠する場合、それはすべてお客様自身の責任で行うものとします。当社は、お客様、本サービスの訪問者、または本サービスの内容を知らされた者が当該情報に依拠したことに起因する一切の責任を否認します。

Japan TCG Directが明示的に記載する場合を除き、本サービスおよび本サービスを通じて提供されるすべての商品は、お客様の利用のために「現状有姿」および「提供可能な範囲」で提供され、明示または黙示を問わず、いかなる表明、保証または条件も伴いません。これには、商品性、商業的品質、特定目的への適合性、耐久性、権原および非侵害に関する黙示の保証または条件を含みます。

当社は、お客様による本サービスの利用が中断されないこと、適時であること、安全であること、またはエラーがないことを保証、表明または約束しません。一部の管轄区域では、黙示的保証その他の保証の免責を制限または認めていないため、上記の免責がお客様に適用されない場合があります。

第17条 責任の制限

法律で認められる最大限の範囲において、Japan TCG Direct、当社のパートナー、取締役、役員、従業員、関連会社、代理人、請負業者、サービス提供者またはライセンサー、ならびにShopifyおよびその関連会社は、いかなる場合においても、傷害、損失、請求、または直接的、間接的、偶発的、懲罰的、特別または結果的損害について責任を負いません。

これには、利益の損失、収益の損失、貯蓄の損失、データの損失、交換費用、または類似の損害を含みますが、これらに限られません。これらの損害が契約、不法行為（過失を含む）、厳格責任その他の法理に基づくものであるかを問いません。

また、本サービスの利用または本サービスを通じて取得した商品に関連する請求、コンテンツの誤りまたは記載漏れ、本サービスを通じて投稿、送信、提供されたコンテンツまたは商品を利用した結果発生した損失または損害についても、たとえその可能性について通知されていた場合であっても責任を負いません。

第18条 補償

お客様は、以下に起因または関連して第三者に対して支払うべき損失、損害、責任または請求について、合理的な弁護士費用を含め、Japan TCG Direct、Shopify、ならびに当社の関連会社、パートナー、役員、取締役、従業員、代理人、請負業者、ライセンサーおよびサービス提供者を補償し、防御し、免責することに同意します。

（1）お客様による本利用規約または参照により組み込まれる文書の違反
（2）お客様による法律または第三者の権利の侵害
（3）お客様による本サービスへのアクセスおよび利用

当社は、補償対象となる請求についてお客様に通知します。ただし、通知が遅れた場合であっても、お客様に重大な不利益が生じない限り、お客様の義務は免除されません。当社は、お客様の費用負担により、当該請求の防御および和解を管理する場合があります。これには弁護士の選任を含みます。ただし、お客様の同意なく、お客様に非金銭的義務を課す和解を行うことはありません。お客様は、関連資料の提供を含め、補償対象となる請求の防御に協力するものとします。

第19条 分離可能性

本利用規約のいずれかの条項が違法、無効または執行不能と判断された場合でも、当該条項は適用法で認められる最大限の範囲で執行可能とされ、執行不能な部分は本利用規約から分離されたものとみなされます。その判断は、その他の残存条項の有効性および執行可能性に影響を与えません。

第20条 権利放棄および完全合意

当社が本利用規約上の権利または条項を行使または執行しない場合であっても、当該権利または条項を放棄したものとはみなされません。

本利用規約ならびに当社が本サイト上または本サービスに関連して掲載するポリシーおよび運営規則は、お客様と当社との間の完全な合意および理解を構成し、お客様による本サービスの利用を規定します。これらは、お客様と当社との間の過去または同時期の合意、連絡、提案（口頭または書面を問いません）に優先します。これには、以前のバージョンの利用規約を含みます。

本利用規約の解釈に曖昧さがある場合でも、作成者に不利に解釈されるものではありません。

第21条 譲渡

お客様は、当社の事前の書面による同意なく、本契約または本規約に基づく権利もしくは義務を委任、移転または譲渡することはできません。そのような試みは無効となります。当社は、お客様の同意または通知なく、本規約および当社の権利義務を移転、譲渡または委任することができます。

第22条 準拠法

本利用規約および当社が本サービスを提供するための個別契約は、日本法に準拠し、日本法に従って解釈されるものとします。本規約に起因または関連して生じる紛争については、日本の裁判所を専属的管轄裁判所とします。

第23条 見出し

本契約で使用される見出しは便宜上のものであり、本規約を制限またはその他の方法で影響するものではありません。

第24条 利用規約の変更

お客様は、本ページにおいて、いつでも最新の利用規約を確認することができます。

当社は、当社の単独の裁量により、本利用規約の一部を更新、変更または置き換える権利を有します。その場合、当社ウェブサイト上に更新内容および変更内容を掲載します。お客様は、変更を確認するために当社ウェブサイトを定期的に確認する責任を負います。

当社は、適用法に従い、本規約の重要な変更についてお客様に通知します。当該変更は、通知に記載された日に効力を生じます。変更掲載後にお客様が本サービスの利用またはアクセスを継続した場合、当該変更に同意したものとみなされます。
